Training

Human Rights Training is now available in the TRAIN learning management system!

TRAIN will house and streamline access to recorded, live virtual, and live in-person trainings facilitated by the Office of Human Rights. Upon creation of an account, training participants are able to self-manage registration, attendance, and completion of post training assessments. Additionally, TRAIN will maintain a list of the account holders’ courses completed or in progress, as well as any certificates associated with completed courses.

Please refer to the TRAIN Account Creation – Form Guide before creating a new TRAIN account. Clicking the TRAIN icon above will take you to the log in screen for TRAIN. Clicking the “HELP” tab in your account will give you access to video tutorials about the different features and capabilities in TRAIN, and information about the status of courses completed.

Each person who intends to complete one or more courses will need to have an account and must complete their profile. Each person must register for each course independently. Accounts cannot be made as an agency. It is recommended that you create and account using an active personal email that you have access to, which ensures ongoing access to course work despite employment location. Certificates of completion are connected to individual accounts.

When seeking to register for attendance, please be sure to begin your search for the course title in the search bar – beginning each course search with: DBHDS: Office of Human Rights (ex: DBHDS: Office of Human Rights – Reporting in CHRIS). *Investigating Abuse and Neglect is NOT searchable on the COURSES tab, but can be found by searching on the Training Plan tab.

Are the training presentations available for viewing? 

No – not all trainings are available to be viewed. Trainings are accessed via the TRAIN learning management system. Please see the following regarding the format of the trainings facilitated by the Office of Human Rights:

No. CEU certificates are only available to participants attending a live/virtual training presentation by request.

What is the stance on “dignity of risk” related to the practice of allowing Individuals to take risks and/or make mistakes so that they may learn from their mistakes? 

Individuals receiving services maintain protection to exercise their legal, civil and human rights (see 12VAC35-115-20). For individuals who maintain legal competency and have not been determined to lack capacity based on an evaluation (see 12VAC35-115-145), this extends to making overall life decisions. Everyone should have the opportunity to learn from their life decisions, regardless of whether those decisions are deemed “good” or “bad.”  

Providers are responsible for ensuring individuals have the information needed to make informed decisions. Providers are also required to maintain a safe and therapeutic service environment for all individuals receiving services and in so doing, may limit an Individual’s rights in the context of service delivery, if done in accordance with the regulations or other applicable law (see 12VAC35-115-50, and 12VAC35-115-100).

Frequently Asked Questions (FAQs) About Provider Orientation

Is there a certificate for this training?

Yes – a certificate for this orientation will be provided in the TRAIN Learning Management System for those that successfully pass the post-training assessment with a score of 80% or better.

Is this training required? 

No, this orientation is not required. It is highly recommended for new and existing providers because it reviews the Office of Human Rights processes and compliance expectations.

Is this training provided live?

No – Provider Orientation is not presented live at this time

Where can I get a copy of the slides?

Can I come to this training more than once?  

Yes – an initial applicant, new provider, or existing provider; or any person interested in the operations or expectations of the Office of Human Rights may attend this orientation and attend as many times as they wish

How can I find out who my Regional Manager is?

Where can I find the current Human Rights Regulations?

The current version of the Human Rights Regulations (12VAC35-115) can be located by visiting the Virginia Legislative Information System (LIS).

How can I get templates for the policies and process described in this training?

There are guidance documents for:

Abuse and Neglect Investigation Summary

OHR does not provide templates for policies, however, does provide technical assistance about what should be included in provider policies and processes. OHR will review draft or revised policies. Providers can request a policy review or technical assistance by contacting the Regional Manager where the service is being provided.

Where can I find templates or examples of questions for the competency assessments for staff
training?

OHR does not provide templates for competency assessments. Competency tests are created internally by the Provider, covering how the regulations apply to their service. A great resource for aiding in creating questions for competency assessments is having provider leadership or trainers attend Overview of the Human Rights Regulations training. The content from this training can aid in developing questions you want to ensure your staff understand regarding human rights policies and procedures; however – sending staff to this training does NOT meet the requirement of the Provider staff
having human rights training at hire and annually.

Abuse and Neglect – Investigative Review Process (Supplemental Training Video)

Please note that reviewing this training video does not constitute meeting the regulatory or policy requirement of being a trained investigator in totality; nor replaces the need to attend the live web-based Investigating Abuse and Neglect training to obtain the certificate to be considered a trained investigator. This training video is a supplemental resource only, and is an informational review of the process regarding investigation of abuse and neglect. Providers may use the video as a supplemental resource after an employee has received the full training, or as an interim solution when the provider staff has registered for the next available live web-based training AND the training session is more than 30 days away.

This training is designed as an overview for consultive professionals working with individuals and providers who are within the DBHDS service delivery system on regulatory requirements and processes. The information will inform the way non-licensed providers support the rights of individuals including how to report potential violations, approval procedures for restrictive treatment plans and the local human rights process.

This training is designed to educate the learner on the regulatory principles and practices pertaining to an individuals’ Dignity of Risk in service participation. *Registration for this training is limited in attendee capacity, as this is a highly interactive training. State Operated Facilities Training Slide Decks: 

The Human Rights Regulations require facilities to complete competency-based human rights training of employees upon employment and at least annually thereafter with documentation maintained in the employee’s personnel file [12VAC35-115-260(A)(7)].

This presentation was previously designed by OHR to be facilitated by training staff to educate new employees of facilities in regulatory practices and compliance with the Human Rights Regulations. The presentation appendix includes additional slides that may be incorporated into the required material to provide supplemental education tailored to specific facility needs and preferences. This presentation should continue to be used by facility training staff to complete both initial and annual training.

Slide Deck – customizable 

The Office of Human Rights has partnered with Facility Services in their development of an expanded Facility Investigator Training and Certification Program set to roll out by August 2026. The purpose of this Program is to standardize, train and certify impartial, trauma-informed abuse/neglect investigations across DBHDS facilities; ensure timely reporting, sound evidence handling, and objective documentation to support CEO determinations. The role of OHR is to support curriculum development by ensuring content including terminology and themes are in alignment with  the Human Rights Regulations and relevant OHR processes (such as the Fact-Finding Review and look-behind initiatives).

A redesigned CHRIS training course has been developed and is now available in the COVLC. There are two versions of this training aimed at different audiences: 

1.  DBHDS-Facilities Reporting in CHRIS: Entry Staff – is a one-hour course that is designed for staff at facilities who enter information into CHRIS but are not responsible for making decisions on reporting or investigating. This training is required to be completed annually for any employee with a CHRIS login. Newly hired or newly assigned staff should incorporate completion of this training into the on-boarding process. This training does include a competency-based test.

2.   DBHDS-Facilities Reporting in CHRIS: Administrators – is a slightly longer training designed for decision makers in facilities and expands on the elements of CHRIS reporting by incorporating background information, guidance documents and making determinations of human rights violations. This training is optional but recommended for leaders and staff with oversight responsibilities related to reporting, investigating and resolving human rights complaints. This training does include a competency-based test.

Slide Deck 

This training has been developed by the Office of Human Rights to address requirements outlined in the Human Rights Regulations specific to human rights restrictions, behavioral treatment plans (BTPs) involving restraint and the use of seclusion and restraint. The target audience of this training includes medical, clinical and nursing staff as well as leaders. The training will be offered virtually by the Office of Human Rights’ Training and Development Coordinator at least twice per year.


New Provider Orientation  

The Provider Orientation is designed help newly licensed and/or funded providers by introducing them to Human Rights processes and expectations for compliance, including:   

  • Human Rights Policies and Procedures  
  • Human Rights Training Curriculum and Competency Assessments   
  • Investigation Certification  
  • DELTA Account Log-In/Computerized Human Rights Information System (CHRIS)  
  • Additional Human Rights Trainings and Resources  

Each virtual session repeats monthly, and is scheduled the fourth Wednesday of each month, from 10 a.m. – 12 p.m. Certificates are not provided for orientation attendance 

If a provider would like a certificate of completion, they need to access and complete the training in TRAIN.
